Upon a separation both parents are entitled to custody of their child/children. It is always preferable for the parents to agree on what their parenting schedule should look like, however, if that is not possible then the court will determine that issue based solely on what is in the best interest of the child/children. There are numerous factors that are considered in determining what is in the best interest of the child/children and it is critical to get good legal advice on this issue. Every parent has the privilege and obligation to support their child/children. There are Child Support Guidelines that assist in determining child support, however, the issue is not always straightforward and can sometimes be complex. The amount of child support to be paid and how long that support is to be paid can be complicated. Let us look at your specific situation and we will help you to understand what your obligations and rights are on this issue.

Spousal Support

There are Spousal Support Advisory Guidelines in place to assist in resolving this issue, but determining your spousal support entitlement or obligation can be a difficult road to navigate without proper guidance. Good legal advice on this issue is critical before you make any decision that will affect your financial future. We can provide you with that advice.

Division of Property

Many people believe that the division of their property is a simple process of dividing everything equally. It’s considerably more complicated that this and the division of property is not the same for married spouses and common law spouses. Division of assets and debts on separation is often a complex process in which numerous factors have to be considered. Having an experienced advocate provide you with the advice and direction that you need on this important financial issue is extremely important, especially at what may be the most emotional and distressing time of one’s life.
